View Full Version : Underage Possession of Alcohol Ticket

well, as the title says....

i just know some of you are law enforcement here, and wanted to know your take on my situation. or just you non law enforcement, i guess i'll listen to your advise too.

so as you all may or may not know, im at college now...and the mustang is just sitting at home in the garage...:(

but its family weekend down here, and so my parents came down, and were being lame last night, so they headed in to their hotel early. So i decided, hey, friday night...might as well have a beer....so i had a couple of beers at my apartment and decided to meet up with a girl friend at this bar a block away.

since its parents weekend i had to go and meet her parents, and what not...and so i get a cup and they pour me a drink.

not thinking, i get my cup filled up and decide i need to go to the bathroom. So, naturally i walk to the bathroom with my beer...

...as soon as i walk out of the bathroom, two cops grap me by each arm...and i wasn't stumbling, acting drunk or stupid or anything...i was drunk, but i am very good at concealing my drunkness.

anyways, they guide me out of the bar, and first thing they ask "do you have your ID on you"...usually in the past, the answer is always "No" in any situation for me. If a cop wants to see my ID, its never a good thing...and then with ID, they know who you are, which is usually not a good thing.

so they just fed me the line "well you HAVE to have an ID on you, how'd you get into the bar?! You know we're going to search you and find it anyways"

and im drunk, so i use my freedom to choose not to speak. And next thing you know, probably 10 seconds after my pee i have my hands on the hood of a cop car. And next thing i know they're pulling my wallet out of my pocket (and i had my ID in my front pocket) and checking all my pockets, while asking me where i normally keep my ID, and i told them in my front pocket.

so they get my ID, and i look over to one of the cops, and he looks YOUNG, and so im like "hey can i ask you a question? how old are you?" and hes like "31"...this guy was probably not a day past 25.

but i use my right to not speak there on after, and they explain rights and blah blah blah, and ask if i understood, being mad and not speaking, i didn't respond.

so he says "well you know, i can not give you the option to just mail this in, im starting to regret giving you this option to mail it in..." (mail in the $250 fine and call it a day). So i said i understood, and he told me i was free to go.

so now, here is the question...should i go to court?

the ticket is merely just an underage possession of alcohol ticket. (I am 20 years young).
the ticket states:
"In that the above named was walking N/B (donno what n/b means) through the beer garden at pinch penny carrying a clear plastic cup containing suspected beer and told me he did not have his ID when in fact he did"

that sucks greg. if it was campus poilce its not a big deal. if its regular police you might have some problems ahead of you

Who's to say it wasn't near-beer, which may or may not be illegal for under 21 to possess. It may be worthwhile for you to fight it if it becomes part of your criminal record, could haunt you in the future but I doubt it, who hasn't had a beer when underage. Tickets like that are pretty much like a jaywalking ticket, no big deal. Find out if the place sells near-beer and whether or not it's legal for under 21 to drink.

BTW N/B doesn't stand for near-beer, it means north bound.

near bear is still illegal to have if your under 21... Because it does still contain some alcohol in it.. Try buying some at the store you get carded and can't get it.

Just pay it dude... i wouldnt take it to court... doubtful you would win... if you werent drunk it may have been easier to defeat their bust because im sure that they didnt do everything right....

yeah i just paid it....i figured, F it

but i just got pulled over and got a speeding ticket just last week....sad part is i was just crusin in my jeep going to class

you dumbass... lol just rember the 5 rule... police have to give you 5 over. if you are ticketed for it you can take it to court and get it dropped.

Not so grasshopper...........you can a ticket for 1 mph over. If it says 35 don't do 36 or 35.3 or 35.7. There are cops out there that will not bend an inch. I was not one of them. :thumbsup:

State of FL is required to give you 5 over. and most cops wont bug you about it either...

im sure you know G that in MD its not illegal for anyone under 21 to consume alcohol. MD and NY are the only states on the east coast that the laws are like this.
